BY ORDERING, THE CUSTOMER IS ASSUMED TO HAVE READ AND FULLY UNDERSTOOD ALL PROVISIONS, TERMS, AND CONDITIONS HEREIN. PLEASE SCROLL DOWN THE ENTIRE PAGE TO READ ALL THE TERMS.

WE CANNOT CONTROL THE WEATHER. WE ARE UNABLE TO REPLACE BOTTLES DAMAGED BY THE WEATHER, SO BE CERTAIN OF CONDITIONS BEFORE ORDERING.

BRIX assumes no liablity for wine damaged due to poor weather during transport. This can include leakage or corks pushing out of the neck as well as "frozen wine pops". So, be sure of shipping conditions before placing a ship order. If you choose a shipping option, WE WILL SHIP regardless of conditions in your area, so be careful.

1) All prices are net, subject to stock, on 750 mL bottles unless otherwise indicated. All orders are subject to our acceptance and we may refuse any order at our discretion. Sparkling wines weigh more, and as such, a small shipping surcharge MAY be added to your order. SHIPPING IS NEVER FREE!

2) Wines may be sold only to persons at least 21 years of age. By placing an order, you are warranting to us that you are 21 years of age. Any order placed by someone under 21 constitutes fraud.

3) Wines may be delivered only to persons at least 21 years of age. Our shippers will require a signature of someone at least 21 years of age at the time of delivery. Positive ID may be required. If the wine is returned to us for failure to provide positive proof of age, the customer is responsible for paying the return shipping charges.

4) Although it rarely happens, we have to state that prices are subject to change without notice. We reserve the right to correct pricing errors.

5) Unless SPECIFICALLY DECLINED, all orders will have insurance charges added. The charge is $.50 per $100 and covers breakage or loss. WEATHER DAMAGE IS NOT COVERED BY THIS INSURANCE! BRIX will cover the insurance for the first $42 of bottle price. See item #9, below.

6) All wine is sold in California, and title passes to the buyer in California. We make no representation relative to your right to import wines into your state or county. The customer, by placing an order, warrants to us that he/she is aware of and in compliance with the laws governing said shipment into his/her area. All orders shipped outside of CA are not subject to CA state sales tax. ALL ORDERS PICKED UP AT OUR LOCATION ARE SUBJECT TO SALES TAX-NO EXCEPTIONS! If BRIX failed to add sales taxes when the order was placed, BRIX reserves the right to correct and collect any sales taxes due.

7) Customer is solely responsible for shipment of wines. Unless you instruct us otherwise, you agree that we shall arrange, on your behalf and responsibility, shipment with a common carrier to make the delivery. We reserve the right to determine the propriety of shipping instructions and may refuse to ship if we deem it inappropriate or unsafe. If shipment is returned for any reason other than BRIX's error, the customer must pay any additional shipping required. SHIPPING IS NEVER FREE!

8) All completed orders will be shipped as soon as practicable using the Air or Ground option you selected. BRIX cannot be responsible if you change your mind after ordering or choose a shipping option in error. SHIPPING IS NEVER FREE!

9) BRIX assumes no liability for wine damaged due to poor weather during transport. This can include leakage, freezing, or corks pushing out of the neck. So, be sure of shipping conditions before placing a ship order.

10) If your area is experiencing extreme weather conditions, BRIX will "hold" wines for future shipment. BRIX will NOT "hold" wines for the sake of convenience, ONLY for extreme weather conditions. A nominal fee is required and a restocking or cancellation fee (10% or $25.00, at our discretion) will apply to changes to "hold" or "pre-arrival" orders. If "hold" wines are damaged due to an Act of God, BRIX cannot be held responsible. If "hold" orders are not shipped within six months of purchase, we may assess additional storage fees in any amount or sell the items solely at our discretion, and our liability in such cases is limited to the original transaction price.

11) For "hold" and "pickup in-store" orders, we require a 6 bottle minimum purchase per order. For "pre-arrival" orders, BRIX requires 3 bottles minimum per item, and 6 bottles total per order. In some few cases (notably Port and pre-determined combination Packages), we may require a slightly larger order. "Hold" and "pre-arrival" orders cannot be combined to meet these minimums.

12) On older vintages, we make every effort to secure wines that are in top condition, and we do not accept questionable goods. For wines that are five years old or older, it is the industry standard and the policy of BRIX that such wines are purchased at the buyer's risk in case of a problem.

13)"Pickup in-store" orders must be picked up by the customer (or agent) within 6 weeks of the date of the order. After 6 weeks BRIX may asses storage fees and may cancel the order at its discretion. Our liability in such cases is limited to the original transaction price. "Pickup in store" purchases are subject to a six bottle minimum per order, and BRIX may refuse any order not meeting this minimum.

14) BRIX requires that each order contain the correct billing address for the credit card used. If we are unable to verify the billing address information you provided, then BRIX will be UNABLE to accept your order and shall have no liability regarding your ability to obtain a particular item.

15 )A small shipping surcharge will be added to orders containing sparkling wine, due to the greater weight of these bottles.

16) Shipping charges for glassware, accessories, and future/prearrival items will be added to your order. Shipping charges for these items ARE NOT included on your invoice and we will add them later!

Please note: BRIX does not permanently store credit card information on the web server. Your credit card information will be retained on the server during order fullfillment only. After your order is finalized, your credit card information will be automatically removed from the server.

2. Shipping
Q: How do we ship?
A: If you don't select the "Hold" shipping option or one of the Air services, we will ship your order immediately using Ground service by one of several carriers. Remember, by ordering you've agreed to the terms in our Terms and Conditions.

Q: How much is shipping?
A: It depends on where you are and how much you order. Generally, ground shipments (where legal) East of the Mississippi are about $34.00 per case of 12 bottles, shipments between the Rockies and the Big Muddy are $21-31 per case, and to the West Coast are $16-21 per case. These rates can vary, and Next Day and 2 Day rates are about twice the price of Ground service. We accept smaller orders, but the smaller the order, the more it costs per bottle. Please email us with your state, ZIP code, number of bottles, and level of service (2day, Overnight, or ground) and we'll respond with a rate. Sparkling wines weigh more, and a shipping surcharge will be added to orders containing bubbly. Shipping charges for glassware and accessories ARE NOT INCLUDED in your invoice and will be added later.

Q: How quickly will the order be delivered?
A: Generally, orders with all items in stock ship within two business days. Delivery takes an additional 4-10 working days for ground service (a bit quicker if you're on the West Coast).
3. Special Instructions
Use the "Order Notes" field to tell us your requirements, and we will do our best to fulfill them. If we cannot, we'll let you know so you can make alternate arrangements. It normally takes us a day or two to prepare your order, so if you don't let us know the date you need it, we'll take care of the order as usual.
